Alleged infringement of rights: Court grants lawsuit against IGP and others

Alleged infringement of rights: Court grants lawsuit against IGP and others

A lawsuit alleging that Inspector General of Police (IGP) Kayode Adeolu Egbetokun has been wrongfully holding a student since September 7 will be heard by a Federal Capital Territory High Court in Gudu on November 13.

In the lawsuit titled FCT/HC/M/057/2023, the Attorney-General of the Federation (AGF), Mr. Lateef Fagbemi, SAN, has also been joined as a defendant.

Mohammed Rabiu, a businessman and student who was allegedly imprisoned illegally, must appear before the court on the date of adjournment, according to a directive from Justice M. M. Adamu to the AGF, IGP, and four other parties.

After hearing arguments from Mr. Terkaa Jerry Aondo, the applicant, the court issued the order.

“The arrest of the applicant (his client) in the circumstances is unlawful as his continued detention in an underground cell at the old SARS building Abattoir Guzape Abuja,” his attorney Terkaa claimed in an affidavit supporting the request ex-parte.

“The Fourth Respondent’s planned violation of the Applicant’s rights, which resulted in the Applicant’s arrest.”

“Restraining the respondents from violating the applicant’s fundamental rights in the future is imperative. Additionally, the cars and money obtained from his relatives under the pretense of recovering debt owed to the 4th respondent on behalf of the Nominal Complainant must be released immediately.”

The applicant’s attorney went on to say that by letting the applicant outside once a day to gasp for air without getting medical help, the fourth respondent is toying with his life.

In his verdict on the ex-parte motion in the litigation with the file number FCT/HC/M/057/2023, Justice M. M. Adamu stated that “an order is hereby made to produce the applicant before this court on November 13, 2023, upon hearing the application of the learned counsel for the applicant.”

“Therefore, an order is hereby made abridging the time for hearing the application on notice to three days and granting an accelerated hearing of the motion on notice.”

Other people The Nigeria Police Force (NPF), Pataka Hananiah, and Abdulhafeez Garba are named as respondents in the lawsuit.
