All of the arguments made in the appeal against the appellant were addressed by the court.The Labour Party's Chijioke Edeoga, the appellant, had brought INEC and Mbah before the court to contest the Court of Appeal's ruling that had rejected his challenge to the governor's election.
In a unanimous ruling, the Lagos Division of the Appeal Court addressed each of the three points raised against the appellant, Edeoga. The appellant was unable to provide evidence showing the respondent lacked the necessary qualifications to run for governor, according to the three-member panel led by Justice Tani Hassan.
Regarding the charge of excessive voting, Hassan concluded in her lead judgment that the voter's registration was never submitted to the lower tribunal, emphasizing that this made the appeal inadmissible.
The appellant's witnesses' testimony did not establish that there was excessive voting in the gubernatorial race, the court further found.
As a result, the court rejected the appeal as being without merit and maintained the election tribunal's decision to confirm Mbah of the PDP's victory as governor in the March 18 election. Mbah of the Progressive Democratic Party was proclaimed the victor of the March 18, 2023 election by the Independent National Electoral Commission.
