According to Oshodi, the prosecution was unable to establish Adejumo's defilement beyond a reasonable doubt.
He declared that he was unable to draw the conclusion that the defendant and the minor had engaged in sexual activity.
"I think the mother was an important witness, but the prosecution's story of circumstantial evidence ended when she chose not to testify.
"Considerable, comprehensive, and unambiguous circumstantial evidence is necessary for a conviction.
"The medical professional (prosecution witness 1) did not name the defendant as the offender or indicate that the defendant's penis was the site of the forceful blunt penetration.
He declared, "The doctor acknowledged that no semen attributable to the defendant was harvested."
The second prosecution witness, the investigating police officer, disclosed that the defendant refuted the accusation, according to Oshodi.
"He didn't necessarily commit the crime, even if he did flee from a police station.
He declared, "Therefore, the circumstantial evidence the prosecution relied upon is not complete, compelling, or unequivocal."
The judge pointed out that everyone accused of a crime should be considered innocent unless and until proven guilty, according to Section 36(5) of the 1999 Constitution.
He said that the proof had to be beyond a reasonable doubt and that the presumption put the onus of proof on the prosecution.
He declared: "It is preferable for nine criminal people to go free in this instance rather than one innocent person being wrongfully condemned because the prosecution was unable to prove the defilement charge beyond a reasonable doubt.
Therefore, even while the guilty might get away with it today, they might not the next day, and society might have an opportunity to exact revenge on him later on, but there is little prospect of undoing what has been done when an innocent person is harmed by a mistake in the criminal justice system.
It is necessary for me to decide the case in the defendant's favor and against the prosecution.
"The defendant is found not guilty, and I acquit and release him."

It called two witnesses, with the defendant and a church member testifying on behalf of the defense.
