On November 23, 2023, two influential traders reportedly broke into the shopping complex with the alleged intention of enforcing a court order or judgment. Following this unsuccessful takeover attempt, the Chairman and Secretary of the Caretaker Committee, Anslem Dunu and Leonard Ogbonnia respectively, issued a public notice. In the notice, they clarified that the invasion was fraudulently contrived, based on stale and illegitimate lawsuits in which neither BBA nor its members were parties.
The public notice emphasized that the incumbent caretaker committee and its members were not involved in the lawsuits and were not parties to the contemptuous legal actions. It accused the two individuals of misinforming and manipulating both the court and the Nigeria Police Force to execute a purported judgment against BBA.
Furthermore, the committee revealed that the individuals, claiming to have been elected as members of an unauthorized executive council, initiated their lawsuit after the Federal High Court had already nullified their previous "elections." The Caretaker Committee stressed that the court orders invalidating the so-called elections are still in effect and predate the new contemptuous lawsuit.
The committee advised its members to disregard the actions of these individuals, asserting that the association and the incumbent Caretaker Committee are supported by existing court orders, decisions, pronouncements, and judgments. It also warned members, affiliates, and stakeholders against entering into any contractual relationship with the two individuals or their representatives, as they do not represent BBA.
