The Labour Party alleges a scheme to thwart Rep. Oga's appeal.
Rep. Amobi Oga (LP-Abia)'s appeal at the Court of Appeal sitting in Lagos is allegedly being thwarted, according to Mr. Obiora Ifog, the Labour Party's (LP) national publicity secretary.


Ifog, stated in an open letter sent on Friday in Abuja by the party's leadership to Prof. Mahmood Yakubu, Chairman of the Independent National Electoral Commission (INEC).


In the Isikwuato/Umunneochi Federal Constituency of Abia, he said that Ogah of the Labour Party ran for and won with a sizable margin.


He claimed that the electoral tribunal had declared his victory to be invalid, leading to his decision to appeal the decision.


"We call on you to nip the development in the bud to avoid a disastrous situation," he said. "What played out on Oct. 19th was amazing.


"INEC had hired Senior Counsel J.O. Asoluka (SAN), who had a letter of authorization authorizing him to represent the commission, as its attorneys.


But as soon as the hearing in the Appeal Court started, a different attorney showed up with a new letter of authority to take over the same INEC's case.


He claims that J.O. Asoluka (SAN) was not informed beforehand that a new counsel had been hired.


According to him, the commission did not feel it was necessary to notify the plaintiff of the development as required by law.


"When the issue arose, there was a dispute between the two counsels over who had INEC's permission to represent it in the case.


He claimed that it had finally occurred to LP that the change of legal guard without sufficient notice to the parties involved was a meticulously planned event.


He claimed that despite the fact that the appeal was postponed and the collaborators were able to carry out their plans, we are sounding the alert since time is of the essence.


According to him, doing so would allow INEC to organize its affairs and identify which of the two counsels was authorized to act on her behalf in the appeal.


Therefore, he continued, we are utilizing this opportunity to implore you to look into the dishonorable roles that the commission's legal section was playing and to punish guilty parties.


He claimed that INEC's responsibility in the situation was to uphold the results of the election that it organized and in which Ogah was recognized as the legitimate winner.


He encouraged the commission to reject any appearance of compromise and added that the integrity of the commission should not be compromised by a small number of members.
