Date for hearing in Atiku v. Tinubu case set by Supreme Court
The appeal by PDP presidential candidate Atiku Abubakar over the election of Bola Ahmed Tinubu of the All Progressive Congress (APC) as president will be heard by the Supreme Court on Monday, October 23, 2023.


The Independent National Electoral Commission (INEC) had proclaimed Tinubu the winner of the election on February 25, but Atiku had petitioned the presidential election tribunal to void the results.


The panel, however, dismissed the plea due to its lack of merit.


The ex-vice president appealed the decision to the Supreme Court because he was dissatisfied with the decision.


Atiku's appeal has been scheduled for hearing on Monday, the Supreme Court Registrar, Zainab Garba, revealed in a notice on Thursday.


"Please be advised that the Supreme Court of Nigeria, sitting in Abuja, will hear the aforementioned appeal/motion on Monday, October 23, 2023.


And take note that Order 2 Rule 1(2) of the Supreme Court Rules 1985, as amended, states that this NOTICE is deemed to have been properly delivered to you if it is left at your address of service or sent by registered mail. Since the date of service by mail is significant, Section 26 of the Interpretation Act, 1964 shall apply.


With the highest vote total of all the contenders (8,794,726), Tinubu defeated the other 17 candidates in the election and satisfied the first constitutional condition for winner declaration.


Additionally, he received more than 25% of the votes cast in 30 states, which is more than the legally required 24 states.
