A businessman was charged with abusing his wife after she discovered him driving her car to pick up another woman.
A Kenyan businessman was charged with assault and malicious property damage after his wife allegedly challenged him for using her car to drive another woman around and claimed he beat her and damaged her phone.


Mr. Polycarp Omondi was accused of violating section 251 of the Penal Code by physically harming Ms. Rosemary Anyango at her home in Tena Estate, Nairobi, on September 18, 2023.


In addition, Mr. Omondi was charged with property destruction in violation of section 339 (1) of the Penal Code for allegedly deliberately and willfully causing damage to Ms. Anyango's phone, which was valued Sh57,000.


When Ms. Anyango saw it on the road, she was traveling in a public service vehicle (PSV) to her husband's business to pick up her automobile.


She got off the PSV and hired a boda boda rider to assist her track down her husband because she thought he might be having an affair.


Mr. Omondi parked his car after driving to a pub in the Buruburu estate.


Ms. Anyango then got off the bus and stood back to watch him.


After a while, Mr. Omondi and a woman left the pub and went to the car, where they locked themselves.


Ms. Anyango approached the vehicle and knocked, but Mr. Omondi disregarded her and drove away.


In an effort to stop the automobile from continuing down Outering Road, Ms. Anyango and her rider overtook it. Mr. Omondi allegedly knocked them to the ground, leaving the rider with bruises.


Driving home, he was discovered by Ms. Anyango, who demanded her car keys and ejected him from her residence.


She claims that the guy assaulted her by grabbing her and strangling her.


Later, when she tried to use the phone to make a call, Mr. Omondi allegedly took it from her and slammed it to the ground.


After Ms. Anyango reported the incident to the police and went to the hospital, Mr. Omondi was taken into custody.


Before Senior Principal Magistrate Hellen Okwany of the Makadara Law Courts, Mr. Omondi refuted the allegations and informed the court—through his attorney Melisa Achieng—that he had resolved the issue with the complainant, who was prepared to drop the case.


Ms. Anyango, however, had not appeared in court to withdraw the claim.


The culprit was freed after posting a Sh50,000 cash bond.


The case will be brought up on November 15, 2023, for potential withdrawal, and if nothing is withdrawn, the hearing will begin on March 26.
